These Terms & Conditions (the “Terms”) govern your access to and use of the website, applications, and services made available at PlaceYourSkill.com (collectively, the “Service”), which is operated by PlaceYourSkill.com (the “Company”, “we”, “us”, or “our”). By accessing, registering for, logging into, or otherwise using the Service, you (the “User” or “you”) acknowledge that you have read, understood, and agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

By creating an account, checking the acceptance box presented at registration or login, or by accessing or using any part of the Service, you signify your unconditional acceptance of these Terms. You represent and warrant that you are at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, and that you possess the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Description of the Service

The Service provides software-assisted tools that format, structure, and optimize resumes and cover letters with the objective of improving their compatibility with Applicant Tracking Systems (“ATS”). The Service generates and stores documents based on information you supply and on job descriptions you provide. The Service is provided as an informational and productivity tool only and does not constitute career counselling, legal advice, or employment placement services.

3. No Guarantee of Employment or Interviews

You expressly acknowledge and agree that use of the Service does not guarantee, promise, or assure any particular outcome, including but not limited to the securing of employment, the receipt of a job offer, or the obtaining of an interview. While the Service is designed to optimize your resume and cover letters in a manner that may improve your prospects of passing automated screening and thereby may improve your chances of being invited to an interview, hiring decisions rest solely with prospective employers and are influenced by numerous factors outside our knowledge or control. The Company makes no representation or warranty that any specific result will be achieved through use of the Service.

4. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to keep such information up to date. You agree not to: (a) use the Service for any unlawful, fraudulent, or deceptive purpose; (b) submit content that is false, misleading, or that infringes the rights of any third party; (c) attempt to gain unauthorized access to the Service, its servers, or related systems; (d) interfere with or disrupt the integrity or performance of the Service; or (e) use any automated means to access or scrape the Service without our prior written consent. You are solely responsible for the accuracy and truthfulness of all information you submit, including your work history and qualifications.

5. Intellectual Property

All content, features, functionality, software, text, graphics, logos, and design elements comprising the Service, other than User-supplied content, are and shall remain the exclusive property of the Company and its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You retain ownership of the personal information and content you submit; however, you grant the Company a limited, non-exclusive, royalty-free license to use, process, store, and reproduce such content solely for the purpose of providing and improving the Service. You may use documents generated for you for your own personal, non-commercial job-seeking purposes.

6. Fees, Subscriptions, and Refund Policy

Access to certain features of the Service requires payment of fees in accordance with the plan you select. All fees are quoted and payable in the currency indicated at the point of purchase and, except as expressly set out below, are non-refundable.

Refund Policy: In the event that you cancel a paid subscription, refunds shall be calculated on a prorated basis and only the unused days remaining in your then-current subscription period shall be eligible for refund. Days already elapsed, together with any promotional, discounted, or complimentary periods, are non-refundable. Prorated refunds are calculated by dividing the amount actually paid for the current billing period by the total number of days in that period and multiplying the result by the number of whole unused days remaining at the time your cancellation request is received and processed.

7. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, the Company disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Company does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any documents produced will be free from defects or fully compatible with every Applicant Tracking System.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall the Company, its owners, directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or employment opportunity, arising out of or in connection with your use of, or inability to use, the Service, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if the Company has been advised of the possibility of such damages. In all cases, the aggregate liability of the Company arising out of or relating to these Terms or the Service shall not exceed the total amount actually paid by you to the Company in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, PlaceYourSkill.com, and their respective owners, directors, officers, employees, agents, licensors, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your infringement or violation of any right of any third party; or (d) the content and information you submit to the Service. This indemnification obligation shall survive the termination of these Terms and your use of the Service.

10. Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if we reasonably believe you have breached these Terms or if we are required to do so by law. Upon termination, your right to use the Service will immediately cease. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive any termination.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time in our sole discretion. When we make material changes, we will update the “Last updated” date above. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.

12. Governing Law and Severability

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which the Company is established, without regard to its conflict-of-law provisions. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
